Cancellation Policy
All deposits are non-refundable but may be transferred to an alternative date subject to availability and only within 30 days of the initial deposit payment being received. Any postponements may be considered a cancellation.
Terms & Conditions
Deposit, Confirmation and Cancellation:

A deposit of 40% of the total hire fee is required to secure exclusive use of the cottage for the duration of your stay. The client is liable for the obligations contained herein. This along with your deposit will confirm your booking.

Exclusive use means that the hirer will have sole access, possession, occupation, and control of the site for the duration of the hire period, and the right to exclude others.

A further 30% of the hire fee will be due no later than 6 months before the start of the hire period, with the final balance of 30% of the hire fee due no later than 3 months before the start of the hire period. An invoice will be issued for the amount due.

If full payment of the entire hire fee has not been made by the date 3 months prior to the day of the reservation, 'Your Country Cottage' will regard the booking as having been cancelled by the client and any previous payments made by the client shall be non-refundable.

'Your Country Cottage' has the right to cancel the booking only under the following circumstances:

If we have reason to believe that the booking might prejudice the reputation of the Cottage.

Should guests checking in to the Cottage behave in any way considered to be detrimental, offensive or contrary to normal expected standards of behaviour.

Access:

Check in to the Cottage is from 3:00pm on the day of arrival and check out is at 10:00am on the day of departure.

Payment:

Payments should be made by direct bank transfer.

Additional Housekeeping & Repairs:

The client is responsible for leaving all areas of the cottage in the same condition they find it and will be liable for the costs of any repairs or cleaning required as a direct result of their stay.

The client agrees to reimburse 'Your Country Cottage' for any material loss or damage caused by guests to any part of the Cottage and surrounding grounds.

There will be a walk round by a representative from the Cottage before and after the reservation to inspect the condition of the Cottage and the client will be notified of any repairs or cleaning eventuating from the client’s stay.

If any additional cleaning or repairs are required, an invoice will be issued to the client and must be paid in full within 7 days.
Rules & Regulations:
The following is a list of rules and regulations to be upheld by the client renting the Cottage:

Cars:
-
Cars can be left at the owners’ own risk and 'Your Country Cottage' does not accept liability for loss or damage to property or vehicles belonging to you or to any of your guests however caused. Cars must not be parked in areas causing an obstruction for access to fields/sheds/roads/gateways.

Parties are strictly forbidden.

Noise Levels:

Any music must be kept at a reasonable level as determined by us and if required to it must be turned down at the request of 'Your Country Cottage' if deemed to be causing a nuisance to the neighbouring properties.

Children:

Children are to be supervised by an adult at all times and are not allowed outside the Cottage unsupervised.

Smoking:
-
The Cottage is a non-smoking property. Outdoor ashtrays will be provided, and smoking is permitted in the gardens and grounds. Please ensure all cigarette butts are picked up and removed with rubbish.

Personal Property:

'Your Country Cottage' does not accept responsibility for the property of the client or of its guests.

Any personal items remaining at the Cottage after the event must be removed prior to the client’s departure. 'Your Country Cottage' will not be responsible for any items not taken after this time.

'Your Country Cottage' is not liable for any loss or damage to property owned by or in the custody of the client and their guests.

Liability:

You agree to pay 'Your Country Cottage' for any loss or liability of any kind to the property or any other person caused by you or any of your guests and to indemnify us in full against all injury (including death) to any persons or loss of or damage to any of our facilities or any other property which may arise out of any negligence, act or omission by you or your guests. 'Your Country Cottage's' total liability to you for any loss they suffer will be limited to the total price paid to us by you for the reservation.

'Your Country Cottage' will not be liable for any other loss suffered by you or your guests or any persons associated with your booking.

If any damage caused by you or your guests prevents the Cottage from being used whilst the damage is made good, you will be liable for any revenue lost during this period.

Nothing in this contract shall operate to exclude or restrict either party’s liability for death or personal injury resulting from negligence or fraud or deception.

You shall indemnify and keep indemnified 'Your Country Cottage' from and against all claims, actions, damages, liabilities and costs (including professional fees) arising out of the acts or omissions of you or your guests or any persons associated with your booking, save to the extent that any such claim arises as a result of the negligence of 'Your Country Cottage', theor employees or agents.

Force Majeure:

For the purposes of this Contract, Force Majeure Event means an event beyond the reasonable control of 'Your Country Cottage' including but not limited to strikes or other industrial disputes (whether involving the workforce of 'Your Country Cottage' or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, the effects of epidemics and pandemics, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

'Your Country Cottage' shall not be liable to the Customer as a result of any failure to perform its obligations under this Contract as a result of a Force Majeure Event.

If a Force Majeure Event prevents 'Your Country Cottage' from providing the Cottage on the agreed date, 'Your Country Cottage' shall, without limiting its other rights or remedies and without liability to the Customer, have the right to postpone a booking and the terms of this Contract to an alternative available date by giving written notice to the Customer.

Additional Information:

Every day we make improvements to our property and facilities. We reserve the right to modify any aspect of our property in advance of or during your event.

We reserve the right without the prior written consent of the other parties, to make reasonable changes to this Contract as required by need or by legislation.

We reserve the right without the prior written consent of the other parties, to assign or transfer this Contract or any obligation incurred hereunder to any third party or nominee.
-
This Contract shall be governed by Scottish Law and the parties to this Contract submit to the jurisdiction of the Scottish courts.

By proceeding with a booking, the client completing the reservation confirms their acceptance of the above terms.
